“That government is best which governs least.”  Now that’s a time-honored quote. It’s commonly attributed to Thomas Jefferson, but there’s strong evidence it had another source.  Whatever the case, we know it did not come from US Senator Diane Feinstein, of California, because her latest project is micro-managing the henhouse.

Feinstein and half a dozen colleagues are proposing Senate Bill 3239, which would provide uniform standards for the treatment of egg-laying hens.  It’s backed by lobbyists from the United Egg Producers and the Humane Society of the United States.  The five pages of regulation go to great lengths to promote healthy environments for hens, but paradoxically requires "humane euthanasia of spent hens."  I guess that’s to prevent the poultry version of “useless eaters.”

Six states currently have their own standards and eighteen more are looking into it.

Here’s how Senator Feinstein explains her perceived problem,” As states with disparate standards continue to protect their own egg producers by banning the sale of eggs from States with lower or no standards, a complicated web of state laws will impair interstate commerce."  Strangely enough, Senate Bill 3239 has special provisions just for Feinstein’s home state of California.

Hold on, Senator.  I believe you’re missing the beauty of shared powers between state and federal governments enshrined in the Constitution.  Sure, Congress may regulate interstate commerce, but what’s wrong with buying eggs locally, within state lines?  Isn’t that what most consumers would choose, if given a choice?  And when states are free to experiment with their own regulations, they can learn from each other, instead of being under the thumb of one more one-size-fits-all Washington solution.

Micro-managing the henhouse?  Frankly, Senator Feinstein, I believe you and your colleagues have laid an egg.
